Biography

Emily Rosdeitcher has 15 years’ experience commercial litigation. She spent most of her career practicing at a boutique litigation firm in New York, where she represented insurance companies, hospitals, investors, and other corporate, institutional, and individual clients in state and federal courts. She has litigated a wide range of commercial matters including contract disputes, insurance fraud, defamation, and copyright and trademark infringement. Emily has represented artists, music producers, and filmmakers in contract negotiations and in litigation. She has a strong record of bringing winning results to her clients through her compelling writing and oral advocacy.

Emily also worked at the United Nations in New York and Geneva as a bilingual (French/English) Legal Officer for the UN Administrative Tribunal, a seven-member body that adjudicated employment disputes within the UN and related organizations.

Emily is a graduate of Columbia Law School, where she was an assistant editor of A Jailhouse Lawyer’s Manual, a Columbia Human Rights Law Review publication, and a recipient of The Parker School Recognition of Achievement in International and Foreign Law. She holds a B.A., magna cum laude, from Wellesley College, where she won the French Department prize, and an M.F.A. in film from New York University’s Tisch School of the Arts, where she won her department’s top screenwriting prize. Her NYU thesis film, the award-winning short Ten Souls Rising, screened at festivals around the world.

  • Wrote and argued successful motion to dismiss claims against music distributor for misappropriation of name, likeness and voice, common law copyright infringement and breach of contract.
  • Wrote and argued successful motion to dismiss action against film director by producer alleging breach of contract and quantum meruit.
  • Wrote successful Second Circuit brief in insurance company’s action to recover co-surety’s share of attorneys’ fees awarded to prevailing party in arbitration seeking declaration of non-coverage.
  • Wrote successful motion for summary judgment dismissing trademark infringement action against European music production and distribution companies.
  • Wrote successful motion to dismiss defamation claims against advertising agency, arising from book written by its CEO.
  • Represented French member of Delaware LLC in action seeking inspection of LLC’s books and records; negotiated and drafted settlement agreement.
  • Drafted production agreement between documentary filmmakers and civil rights foundation.
  • Represented New York-based artist in negotiations with London museum for exhibition of artist’s work.

Interesting Facts

Emily returned to practice after taking time off to focus on her family. Emily is a three-time NYC Marathon finisher, and enjoys running, writing, photography, and travel. Fluent in French, she also has a fair knowledge of Spanish, Italian and Russian.
